1. Acceptance of terms

By downloading or using VitaView ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App. These terms apply to all users of VitaView, including free and Pro subscribers.

2. License

Ludyem AS grants you a personal, non-exclusive, non-transferable, revocable licence to use VitaView on Apple-branded devices you own or control, subject to these terms and the Apple App Store Terms of Service.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse-engineer or attempt to extract the source code
• Use the App for any unlawful purpose
• Sell, sublicense, or transfer your rights to any third party

3. Health disclaimer

VitaView is a personal wellness tool designed to help you view and understand data from Apple Health. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always consult a qualified healthcare professional before making decisions about your health, exercise, diet, or medication. Do not rely on VitaView data in place of professional medical judgement.

4. Subscriptions and purchases

VitaView Pro is available as an auto-renewing subscription (monthly or annual) or a one-time lifetime purchase, managed through the Apple App Store.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription in iOS Settings → [Your Name] → Subscriptions.
• Refunds are handled by Apple. Submit refund requests at reportaproblem.apple.com.
• Prices may vary by country and are displayed in the App Store before purchase.

5. Free tier

The free tier of VitaView (up to 3 metrics with full widget support, goals, streaks, journal, and achievements) is available without charge and without a time limit. We reserve the right to change the features included in the free tier with reasonable notice.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these terms by reference. In summary: your health data never leaves your iPhone, we require no account, and we do not sell or share your data.

7. Intellectual property

All content, design, code, and branding within VitaView are the property of Ludyem AS and protected by applicable intellectual property laws. Nothing in these terms grants you any rights to our trademarks, logos, or other brand elements.

8. Disclaimer of warranties

VitaView is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Use the App at your own risk.

9. Limitation of liability

To the fullest extent permitted by applicable law, Ludyem AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of VitaView.

10. Governing law

These terms are governed by the laws of Norway. Any disputes shall be subject to the exclusive jurisdiction of the courts of Norway.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via app release notes or an in-app notice. Continued use of the App after changes constitutes your acceptance of the revised terms.
